International protection and Asylum Spain

What is International Protection and Asylum Spain?

It is the protection that the Spanish state offers to all those people who because of race, religion, nationality, political opinions, belonging to a certain social group, gender or sexual orientation, can be persecuted in their country of origin or fear their physical integrity or psychic.

There are two clearly differentiated groups, in what is International Protection and Asylum Spain; one is refugees and others are in need of subsidiary protection:

  • Refugees, that is, people who have a well-founded fear of being persecuted in their country for reasons of race, religion, nationality, political opinions, belonging to a certain social group, gender or sexual orientation. Refugees are granted the right to asylum.
  • Foreigners who are not refugees, but who cannot return to their country of origin because there are well-founded reasons to assume a real risk of suffering any of these damages:

– Sentence to death penalty.

– Torture or inhuman or degrading treatment.

– Serious threats against life or integrity because of situations of indiscriminate violence. Within this group are also stateless persons, that is, those who lack a homeland or who are not recognized by the Spanish state.

Advantages of International Protection and Asylum Spain

When applying for International Protection and Asylum Spain:

  • Stay in Spain until your application is resolved
  • Be assisted by a lawyer, free of charge if you cannot afford it (Bar Associations or NGOs).
  • Be assisted by an interpreter
  • The request will be communicated to the United Nations High Commissioner for Refugees (UNHCR) in Spain.
  • Know the contents of the file at any time.
  • Be documented as an applicant for international protection.
  • Right to health care in case of need and receive health benefits.

When granting International Protection and Asylum Spain:

  • Not be returned to the country of origin
  • Residence and work authorization.
  • Obtain identity document and, if applicable, travel.
  • Regroup of direct family members
  • Access to public employment services, education, health care, housing, assistance and social services, programs for the care of victims of gender violence, social security, integration programs, continuous training and work in practices, and the procedure of recognition of academic and professional degrees in the same conditions as Spanish.
  • Access to specific integration programs and voluntary return that are established
  • Reduction in the terms of access to Spanish nationality for refugees.

International Protection and Asylum Spain Requirements

The request for International Protection and Asylum Spain must be filed, if it is within Spanish territory, within ONE MONTH from the moment of entry into Spain or from the moment of the events in which the request is justified.

The application for International Protection and Asylum Spain is presented personally or in its absence and always with well-founded reasons may do so through a representative.

Once the application is submitted and soon there will be an interview in which you will have a translator and in which you will be asked about the reasons for the request: how it arrived, etc. You can provide those documents or evidence that you issue timely. Your country of origin will never be informed and the information you provide is completely confidential.
