Find out what you can do if you’ve been refused your residency renewal
There are several possibilities that you can do in case you have been denied the renewal of your residency permit and we explain them below.
Table of contents:
1. What to do if the denial is incorrect:
If your residency application has been denied, there are several possibilities that we are going to explain below.
To begin with, we must check if the denial is correct or not, to find out if the administration is right or not in the refusal, we can also analyze if the denial could have been avoided, if the administration had asked us for the corresponding documents or clarifications. This aspect is important, because the administration is obliged by our own regulations to require documentation or explanations before denying an application.
If we are faced with a case where the application has been denied without having required documents or clarifications, we may appeal and at the same time provide the necessary documentation or explanations in the appeal that is filed.
2. What to do if the denial is correct:
The other possible case is that they have requested us and once we have provided what is required of what they have denied or they really did not have to ask for anything because the denial was clear. In these cases, there are different options to consider.
One of the options is to present an appeal during the one-month period offered, alleging or explaining during this period of time the reasons that are considered appropriate for the residence permit to be approved. It is even possible to provide documentation through this appeal that may or may not be assessed, depending on the case.
Actually, the most important thing in the event of refusal is to have processed the residency well in advance, that is, within the two months prior to the expiration date that the regulations allow us to renew.
This aspect is also important, because in this way it gives us time, if we cannot solve the problem or the cause of the denial, if we can resubmit it, they give us this great advantage, we submit it knowing the reason for the refusal, we submit it knowing where the problem may be and of course solving it.
Also, between an appeal or a new submission, a re-filing is preferable to an appeal, because there are several reasons for it, but it will be better for us to explain it at another time.
